Preambule

Met de volgende privacyverklaring willen wij u informeren welke soorten van uw persoonsgegevens (hierna ook afgekort als "gegevens") wij verwerken voor welke doeleinden en in welke omvang. De privacyverklaring is van toepassing op alle door ons uitgevoerde verwerkingen van persoonsgegevens, zowel in het kader van het verlenen van onze diensten als in het bijzonder op onze websites, in mobiele applicaties en binnen externe online aanwezigheden, zoals onze social media profielen (hierna gezamenlijk aangeduid als "online diensten").

De gebruikte termen zijn niet geslachtsspecifiek.

Overzicht van de verwerkingsactiviteiten

In de onderstaande tabel wordt een overzicht gegeven van de soorten verwerkte gegevens, de doeleinden waarvoor zij worden verwerkt en de betrokken betrokkenen.

Rechtsgrondslagen voor de verwerking

In het volgende informeren wij u over de rechtsgrondslag van de Algemene Verordening Gegevensbescherming (GDPR), op basis waarvan wij persoonsgegevens verwerken. Wij wijzen u erop dat naast de voorschriften van de GDPR ook de nationale voorschriften inzake gegevensbescherming in uw land of in het land waar wij wonen of gevestigd zijn, van toepassing kunnen zijn. Indien daarnaast in individuele gevallen specifiekere rechtsgrondslagen van toepassing zijn, zullen wij u daarover informeren in de verklaring inzake gegevensbescherming.

  • Toestemming (artikel 6, lid 1, onder a), GDPR) - De betrokkene heeft toestemming gegeven voor de verwerking van zijn of haar persoonsgegevens voor een of meer specifieke doeleinden.
  • Uitvoering van een contract en voorafgaande verzoeken (artikel 6, lid 1, onder b), GDPR) - De uitvoering van een overeenkomst waarbij de betrokkene partij is of om op verzoek van de betrokkene stappen te ondernemen voorafgaand aan het sluiten van een overeenkomst.
  • Naleving van een wettelijke verplichting (artikel 6, lid 1, onder c), GDPR) - De verwerking is noodzakelijk om een wettelijke verplichting na te komen waaraan de voor de verwerking verantwoordelijke is onderworpen.
  • Bescherming van vitale belangen (artikel 6, lid 1, onder d), GDPR) - De verwerking is noodzakelijk ter bescherming van de vitale belangen van de betrokkene of van een andere natuurlijke persoon.
  • Gewettigde belangen (artikel 6, lid 1, onder f), GDPR) - De verwerking is noodzakelijk voor de behartiging van de gerechtvaardigde belangen van de voor de verwerking verantwoordelijke of van een derde, behalve wanneer deze belangen moeten wijken voor de belangen of de grondrechten en fundamentele vrijheden van de betrokkene die tot bescherming van de persoonsgegevens nopen.

Veiligheidsmaatregelen

We nemen passende technische en organisatorische maatregelen in overeenstemming met de wettelijke vereisten, rekening houdend met de stand van de techniek, de uitvoeringskosten en de aard, omvang, context en doeleinden van verwerking, evenals het risico van variërende waarschijnlijkheid en ernst voor de rechten en vrijheden van natuurlijke personen, om een op het risico afgestemd beveiligingsniveau te waarborgen.

De maatregelen omvatten met name het waarborgen van de vertrouwelijkheid, integriteit en beschikbaarheid van gegevens door de fysieke en elektronische toegang tot de gegevens te controleren, evenals toegang tot, invoer, verzending, beveiliging en scheiding van de gegevens. Daarnaast hebben we procedures opgesteld om ervoor te zorgen dat de rechten van betrokkenen worden gerespecteerd, dat gegevens worden gewist en dat we voorbereid zijn om snel te reageren op gegevensbedreigingen. Bovendien houden we al bij de ontwikkeling of selectie van hardware, software en serviceproviders rekening met de bescherming van persoonsgegevens, volgens het principe van privacy by design en privacy by default.

Maskering van het IP-adres: Als het voor ons mogelijk is of het opslaan van het IP-adres niet nodig is, dan verkorten wij of laten wij uw IP-adres inkorten. Wanneer het IP-adres wordt ingekort, ook wel "IP-masking" genoemd, wordt het laatste octet, dwz de laatste twee cijfers van een IP-adres, verwijderd (het IP-adres is in deze context een identificatie die door de online toegangsprovider). Met de verkorting van het IP-adres moet de identificatie van een persoon op basis van zijn IP-adres worden voorkomen of aanzienlijk bemoeilijkt.

SSL-codering (https): Om uw gegevens die via onze online diensten worden verzonden zo goed mogelijk te beschermen, gebruiken we SSL-codering. U herkent dergelijke versleutelde verbindingen aan het voorvoegsel https:// in de adresbalk van uw browser.

Doorgifte en openbaarmaking van persoonlijke gegevens

In het kader van onze verwerking van persoonsgegevens kan het voorkomen dat de gegevens worden doorgegeven aan andere plaatsen, bedrijven of personen of dat ze aan hen worden bekendgemaakt. Tot de ontvangers van deze gegevens behoren bijvoorbeeld betalingsinstellingen in het kader van betalingstransacties, dienstverleners in opdracht van IT-taken of aanbieders van diensten en inhoud die in een website zijn ingebed. In een dergelijk geval worden de wettelijke vereisten gerespecteerd en worden in het bijzonder overeenkomstige contracten of overeenkomsten, die de bescherming van uw gegevens dienen, gesloten met de ontvangers van uw gegevens.

Gegevensoverdracht binnen de bedrijvengroep: We kunnen persoonlijke gegevens overdragen aan andere bedrijven binnen onze groep van bedrijven of hen anderszins toegang verlenen tot deze gegevens. Voor zover deze openbaarmaking voor administratieve doeleinden is, is de openbaarmaking van de gegevens gebaseerd op onze legitieme zakelijke en economische belangen of anderszins, als het nodig is om onze contractuele verplichtingen na te komen of als de toestemming van de betrokkenen of anderszins een wettelijke toestemming aanwezig is.

Gegevensoverdracht binnen de organisatie: We kunnen persoonlijke informatie overdragen of anderszins toegang verlenen tot andere locaties binnen onze organisatie. Voor zover deze openbaarmaking voor administratieve doeleinden is, is de openbaarmaking van de gegevens gebaseerd op onze legitieme zakelijke en economische belangen of anderszins, als dit nodig is om onze contractuele verplichtingen na te komen of als de toestemming van de betrokkenen of anderszins een wettelijke toestemming aanwezig is.

Gegevensverwerking in derde landen

Als we gegevens verwerken in een derde land (dwz buiten de Europese Unie (EU), de Europese Economische Ruimte (EER)) of de verwerking plaatsvindt in het kader van het gebruik van diensten van derden of openbaarmaking of overdracht van gegevens aan andere personen , instanties of bedrijven, dit zal alleen gebeuren in overeenstemming met de wettelijke vereisten.

Behoudens uitdrukkelijke toestemming of overdracht vereist door contract of wet, verwerken of hebben we de gegevens alleen verwerkt in derde landen met een erkend niveau van gegevensbescherming, waaronder Amerikaanse verwerkers die zijn gecertificeerd onder het "Privacy Shield" of op basis van speciale garanties, zoals een contractuele verplichting door middel van zogenaamde standaardbeschermingsclausules van de Europese Commissie, het bestaan van certificeringen of bindende interne gegevensbeschermingsvoorschriften (Artikel 44 tot 49 AVG, informatiepagina van de Europese Commissie: International dimension of data protection

Gebruik van cookies

Cookies zijn tekstbestanden die gegevens bevatten van bezochte websites of domeinen en die door een browser worden opgeslagen op de computer van de gebruiker. Een cookie wordt hoofdzakelijk gebruikt om informatie over een gebruiker tijdens of na zijn bezoek aan een onlinedienst op te slaan. De opgeslagen informatie kan bijvoorbeeld de taalinstellingen op een website, de inlogstatus, een winkelmandje of de locatie waar een video werd bekeken, omvatten. De term "cookies" omvat ook andere technologieën die dezelfde functies vervullen als cookies (bv. als gebruikersinformatie wordt opgeslagen met behulp van pseudonieme online-identificatiemiddelen, ook wel "gebruikers-ID's" genoemd).

De volgende soorten en functies van cookies worden onderscheiden:

  • Tijdelijke cookies (ook: sessiecookies): Tijdelijke cookies worden uiterlijk gewist nadat een gebruiker een onlinedienst heeft verlaten en zijn browser heeft afgesloten.
  • Permanente cookies: Permanente cookies blijven ook na het sluiten van de browser opgeslagen. Zo kan bijvoorbeeld de inlogstatus worden opgeslagen of kan de voorkeursinhoud direct worden weergegeven wanneer de gebruiker een website opnieuw bezoekt. Ook de interesses van gebruikers die voor bereikmeting of marketingdoeleinden worden gebruikt, kunnen in zo'n cookie worden opgeslagen.
  • First-Party-Cookies: First-Party-Cookies worden door onszelf ingesteld.
  • Cookies van derden: Cookies van derden worden voornamelijk gebruikt door adverteerders (zogenaamde derden) om gebruikersinformatie te verwerken.
  • Noodzakelijke (ook: essentiële) cookies: Cookies kunnen noodzakelijk zijn voor de werking van een website (bv. om logins of andere gebruikersinputs op te slaan of om veiligheidsredenen).
  • Statistieken, marketing en personalisatie cookies: Cookies worden in het algemeen ook gebruikt om het bereik van een website te meten en wanneer de interesses of het gedrag van een gebruiker (bv. het bekijken van bepaalde inhoud, het gebruik van functies, enz. Dergelijke profielen worden bijvoorbeeld gebruikt om gebruikers inhoud te tonen die overeenstemt met hun potentiële interesses. Deze procedure wordt ook wel "tracking" genoemd, d.w.z. het volgen van de potentiële interesses van gebruikers. . Indien wij cookies of "tracking"-technologieën gebruiken, zullen wij u daarover afzonderlijk informeren in ons privacybeleid of in het kader van het verkrijgen van toestemming.

Informatie over rechtsgrondslag: De rechtsgrondslag waarop wij uw persoonsgegevens met behulp van cookies verwerken, hangt af van de vraag of wij u om toestemming vragen. Indien dit het geval is en u toestemming geeft voor het gebruik van cookies, is de rechtsgrondslag voor de verwerking van uw gegevens uw verklaarde toestemming. Zo niet, dan worden de met behulp van cookies verwerkte gegevens verwerkt op basis van onze gerechtvaardigde belangen (bijv. bij een zakelijke exploitatie van onze online dienst en de verbetering daarvan) of, indien het gebruik van cookies noodzakelijk is om onze contractuele verplichtingen na te komen.

Algemene informatie over het intrekken van toestemming en bezwaar (Opt-Out): Ongeacht of de verwerking is gebaseerd op toestemming of wettelijke toestemming, hebt u te allen tijde de mogelijkheid bezwaar te maken tegen de verwerking van uw gegevens met behulp van cookie-technologieën of de toestemming in te trekken (samen "opt-out" genoemd). U kunt uw bezwaar in eerste instantie kenbaar maken via de instellingen van uw browser, bijvoorbeeld door het gebruik van cookies uit te schakelen (waardoor ook de functionaliteit van onze onlinediensten kan worden beperkt). Een bezwaar tegen het gebruik van cookies voor online marketingdoeleinden kan voor een groot aantal diensten, met name in het geval van tracking, worden ingediend via de websites WebChoices en Your Online Choices. Bovendien kunt u meer informatie over bezwaren krijgen in het kader van de informatie over de gebruikte dienstverleners en cookies.

Verwerking van Cookiegegevens op basis van toestemming: Voordat wij gegevens in het kader van het gebruik van cookies verwerken of laten verwerken, vragen wij de gebruikers om hun toestemming, die te allen tijde kan worden ingetrokken. Voordat de toestemming niet is gegeven, kunnen wij cookies gebruiken die noodzakelijk zijn voor het functioneren van onze online diensten. Het gebruik ervan is gebaseerd op ons belang en het belang dat de gebruiker heeft bij de verwachte functionaliteit van onze onlinediensten.

  • Verwerkte gegevenssoorten: Gebruiksgegevens (bv. bezochte websites, interesse in inhoud, toegangstijden), Meta-/communicatiegegevens (bv. apparaatinformatie, IP-adressen).
  • Betrokkenen: Gebruikers (bijv. bezoekers van websites, gebruikers van onlinediensten).
  • Rechtsgrondslag: Toestemming (artikel 6, lid 1, onder a), GDPR), rechtmatige belangen (artikel 6, lid 1, onder f), GDPR).

Commerciële diensten

Wij verwerken gegevens van onze contractuele en zakelijke partners, bijv. klanten en belangstellenden (gezamenlijk "contractuele partners" genoemd) in het kader van contractuele en vergelijkbare rechtsbetrekkingen alsmede daarmee samenhangende handelingen en communicatie met de contractuele partners of precontractueel, bijv. om vragen te beantwoorden.

Wij verwerken deze gegevens om onze contractuele verplichtingen na te komen, onze rechten te vrijwaren en met het oog op de administratieve taken in verband met deze gegevens en de bedrijfsorganisatie. Wij geven de gegevens van de contractpartners in het kader van het toepasselijke recht alleen door aan derden voor zover dit noodzakelijk is voor de genoemde doeleinden of voor het nakomen van wettelijke verplichtingen of met toestemming van de contractpartners (bijv. telecommunicatie-, transport- en andere ondersteunende diensten alsmede onderaannemers, banken, belasting- en juridische adviseurs, betalingsdienstaanbieders of belastingdiensten). De contractuele partners zullen worden geïnformeerd over verdere verwerking, bijvoorbeeld voor marketingdoeleinden, in het kader van dit privacybeleid.

Welke gegevens noodzakelijk zijn voor de bovengenoemde doeleinden, delen wij de contractpartners mee vóór of in het kader van de gegevensverzameling, bv. in on-line formulieren door speciale markering (bv. kleuren) en/of symbolen (bv. asterisken of dergelijke), of persoonlijk.

Wij wissen de gegevens na afloop van wettelijke garantie- en vergelijkbare verplichtingen, d.w.z. in principe na afloop van 4 jaar, tenzij de gegevens in een klantenrekening zijn opgeslagen of om wettelijke archiveringsredenen moeten worden bewaard (bijv. in de regel 10 jaar om fiscale redenen). Bij gegevens die de contractpartner ons in het kader van een opdracht meedeelt, wissen wij de gegevens volgens de specificaties van de opdracht, in de regel na het einde van de opdracht.

Indien wij gebruik maken van derde aanbieders of platforms om onze diensten te verlenen, zijn de algemene voorwaarden en het privacybeleid van de respectieve derde aanbieders of platforms van toepassing in de relatie tussen de gebruikers en de aanbieders.

Klantenrekening: Contractuele partners kunnen een klanten- of gebruikersaccount aanmaken. Indien de registratie van een klantenrekening vereist is, zullen de contractuele partners hiervan in kennis worden gesteld, alsook van de voor de registratie vereiste gegevens. De klantenaccounts zijn niet openbaar en kunnen niet door zoekmachines worden geïndexeerd. Tijdens de registratie en het daaropvolgende gebruik van de klantenaccount slaan wij de IP-adressen van de contractuele partners op, samen met de toegangstijden, om de registratie te kunnen bewijzen en misbruik van de klantenaccount te kunnen voorkomen.

Indien klanten hun klantenrekening hebben opgezegd, worden hun gegevens met betrekking tot de klantenrekening gewist, onder voorbehoud dat het bewaren ervan om wettelijke redenen vereist is. Het is de verantwoordelijkheid van de klant om zijn gegevens te beveiligen na beëindiging van de klantenrekening.

Diensten van agentschappen: Wij verwerken de gegevens van onze klanten in het kader van onze contractuele diensten, die bijvoorbeeld conceptueel en strategisch advies, campagneplanning, software- en ontwerpontwikkeling / advies of onderhoud, implementatie van campagnes en processen, afhandeling, serverbeheer, gegevensanalyse / adviesdiensten en opleidingsdiensten kunnen omvatten.

Agenten en makelaarsdiensten: Wij verwerken de gegevens van onze klanten, opdrachtgevers en geïnteresseerden (uniform aangeduid als "klanten") in overeenstemming met de onderliggende opdracht van de klanten. Daarnaast kunnen wij gegevens verwerken over de kenmerken en omstandigheden van personen of zaken die aan hen toebehoren, indien dit onderdeel is van onze opdracht. Dit kunnen bijvoorbeeld gegevens zijn over persoonlijke omstandigheden, mobiele of onroerende goederen en financiële situatie.

Voor zover dit noodzakelijk is voor de uitvoering van onze opdracht of wettelijk vereist is, maken wij gegevens van cliënten in het kader van dekkingsaanvragen, het sluiten en de uitvoering van contracten bekend of geven deze door aan aanbieders van de bemiddelde diensten/eigendommen, verzekeraars, herverzekeraars, makelaarspools, technische dienstverleners, andere dienstverleners, zoals samenwerkende verenigingen, alsmede financiële dienstverleners, kredietinstellingen en beleggingsmaatschappijen, socialeverzekeringsinstellingen, belastingdiensten, belastingadviseurs, juridische adviseurs, accountants, ombudsmannen voor verzekeringen en een financiële toezichthoudende autoriteit. Voorts kunnen wij, onder voorbehoud van andere overeenkomsten, opdracht geven aan onderaannemers.

Diensten in verband met reizen: Wij verwerken de gegevens van onze klanten en belangstellenden (uniform aangeduid als "klanten") in overeenstemming met de onderliggende contractuele relatie. Voorts kunnen wij informatie verwerken over de kenmerken en omstandigheden van personen of zaken die aan hen toebehoren, indien dit noodzakelijk is in het kader van de contractuele relatie. Het kan bijvoorbeeld gaan om informatie over persoonlijke omstandigheden, mobiel vermogen en financiële situatie.

In het kader van onze opdracht kan het noodzakelijk zijn dat wij bijzondere categorieën van gegevens in de zin van artikel 9, lid 1, GDPR verwerken, in het bijzonder informatie over de gezondheid van een persoon. De verwerking vindt plaats ter bescherming van de gezondheidsbelangen van de klanten en anders alleen met toestemming van de klanten.

Indien dit noodzakelijk is voor de uitvoering van het contract of wettelijk vereist is, of indien de klant hiermee instemt of op grond van onze legitieme belangen, maken wij de gegevens van de klant bekend of geven wij deze door, bijvoorbeeld aan de dienstverleners die betrokken zijn bij de uitvoering van de reisdiensten.

Evenementen: Wij verwerken de gegevens van de deelnemers aan de door ons aangeboden of georganiseerde evenementen, manifestaties en soortgelijke activiteiten (hierna uniform aangeduid als "deelnemers" en "evenementen") om hen in staat te stellen deel te nemen aan de evenementen en gebruik te maken van de aan hun deelname verbonden diensten of acties.

Voor zover wij in dit kader gezondheidsgerelateerde gegevens, religieuze, politieke gegevens of andere bijzondere categorieën van gegevens verwerken, gebeurt dit in het kader van de openbaarmaking (bv. voor thematisch georiënteerde evenementen of dient dit de gezondheidszorg, de veiligheid of gebeurt dit met de toestemming van de betrokkenen).

De noodzakelijke informatie wordt als zodanig geïdentificeerd in het kader van het sluiten van de overeenkomst, de boeking of een vergelijkbaar contract en omvat de informatie die nodig is voor het leveren van diensten en de facturering, alsmede contactgegevens om eventuele vragen te kunnen beantwoorden. Voor zover wij toegang krijgen tot informatie van eindklanten, medewerkers of andere personen, verwerken wij deze in overeenstemming met de wettelijke en contractuele vereisten.

Verhuur diensten: Wij verwerken de gegevens van onze huurders en van belanghebbenden (uniform aangeduid als "huurder") in overeenstemming met de onderliggende huur- of vergelijkbare overeenkomst. Daarnaast kunnen wij gegevens verwerken over de kenmerken en omstandigheden van personen of zaken die aan hen toebehoren, indien dit noodzakelijk is in het kader van de huurrelatie. Het kan bijvoorbeeld gaan om informatie over persoonlijke omstandigheden, mobiele of onroerende goederen en financiële situatie.

In het kader van onze opdracht kan het noodzakelijk zijn dat wij bijzondere categorieën van gegevens in de zin van artikel 9, lid 1, GDPR verwerken, met name informatie over de gezondheid van een persoon. De verwerking geschiedt ter bescherming van de gezondheidsbelangen van de huurders en anders alleen met toestemming van de huurders.

Indien noodzakelijk voor de uitvoering van het contract of wettelijk vereist, of overeengekomen door de huurder of op basis van onze legitieme belangen, maken wij de gegevens van de huurders bekend of geven wij deze door in het kader van dekkingsaanvragen, het sluiten en uitvoeren van contracten, gegevens bijv. aan financiële dienstverleners, kredietinstellingen, leveranciers (bijv. elektriciteit) of autoriteiten.

  • Verwerkte datatypes: Inventarisgegevens (bijv. namen, adressen), Betalingsgegevens (bijv. bankgegevens, facturen, betalingsgeschiedenis), Contactgegevens (bijv. e-mail, telefoonnummers), Contractgegevens (bijv. contractobject, looptijd, klantencategorie), Gebruiksgegevens (bijv. bezochte websites, interesse in inhoud, toegangstijden), Meta-/communicatiegegevens (bijv. apparaatinformatie, IP-adressen).
  • Betrokkenen: Potentiële klanten, zakelijke en contractuele partners, klanten.
  • Doeleinden van de verwerking: Contractuele diensten en ondersteuning, verzoeken om contact en communicatie, Kantoor- en organisatieprocedures, Beheer en beantwoording van verzoeken om inlichtingen, Veiligheidsmaatregelen.

Verlening van onlinediensten en webhosting

Om onze online diensten veilig en efficiënt te kunnen aanbieden, maken wij gebruik van de diensten van een of meer webhostingproviders vanaf wier servers (of servers die zij beheren) toegang kan worden verkregen tot de online diensten. Voor deze doeleinden kunnen wij gebruik maken van infrastructuur- en platformdiensten, computercapaciteit, opslagruimte en databasediensten, alsmede van diensten op het gebied van beveiliging en technisch onderhoud.

De gegevens die in het kader van de levering van de hostingdiensten worden verwerkt, kunnen alle informatie over de gebruikers van onze onlinediensten omvatten die in de loop van het gebruik en de communicatie wordt verzameld. Daartoe behoort regelmatig het IP-adres, dat nodig is om de inhoud van de onlinediensten aan browsers te kunnen leveren, en alle gegevens die binnen onze onlinediensten of vanaf websites worden ingevoerd.

Verzamelen van toegangsgegevens en logbestanden: Wijzelf of onze webhostingprovider verzamelen gegevens op basis van elke toegang tot de server (zogenaamde serverlogbestanden). Serverlogbestanden kunnen het adres en de naam bevatten van de webpagina's en bestanden waartoe toegang is verkregen, de datum en het tijdstip van toegang, overgedragen gegevensvolumes, melding van succesvolle toegang, browsertype en -versie, het besturingssysteem van de gebruiker, referrer URL (de eerder bezochte pagina) en, in de regel, IP-adressen en de aanvragende provider.

De serverlogbestanden kunnen worden gebruikt voor veiligheidsdoeleinden, bijvoorbeeld om overbelasting van de servers te voorkomen (met name in het geval van misbruikaanvallen, zogenaamde DDoS-aanvallen) en om de stabiliteit en een optimale belastingsverdeling van de servers te waarborgen.

Registratie, aanmelding en gebruikersaccount

Gebruikers kunnen een gebruikersaccount aanmaken. In het kader van de registratie wordt de vereiste verplichte informatie aan de gebruikers meegedeeld en verwerkt met het oog op het verstrekken van de gebruikersaccount op basis van de contractuele nakoming van verplichtingen. De verwerkte gegevens omvatten met name de login-informatie (naam, wachtwoord en een e-mailadres). De bij de registratie ingevoerde gegevens worden gebruikt met het oog op het gebruik van de gebruikersaccount en het doel ervan.

Gebruikers kunnen per e-mail op de hoogte worden gebracht van informatie die relevant is voor hun gebruikersaccount, zoals technische wijzigingen. Indien gebruikers hun gebruikersaccount hebben beëindigd, worden hun gegevens met betrekking tot het gebruikersaccount gewist, behoudens een wettelijke bewaarplicht. Het is de verantwoordelijkheid van de gebruikers om hun gegevens veilig te stellen voor het einde van het contract in geval van beëindiging. Wij hebben het recht om alle gebruikersgegevens die tijdens de looptijd van het contract zijn opgeslagen, onherroepelijk te wissen.

In het kader van het gebruik van onze registratie- en aanmeldfuncties en het gebruik van de gebruikersaccount slaan wij het IP-adres en het tijdstip van de betreffende gebruikersactie op. De opslag is gebaseerd op onze legitieme belangen, evenals de bescherming van de gebruiker tegen misbruik en ander ongeoorloofd gebruik. Deze gegevens worden niet doorgegeven aan derden, tenzij dit noodzakelijk is om onze aanspraken na te komen of er een wettelijke verplichting bestaat om dit te doen.

Discussiebord: Deelname aan het discussieforum vereist een registratie, waarbij een pseudoniem als naam, een wachtwoord en het e-mailadres, waarnaar de toegangsgegevens worden verzonden, moeten worden opgegeven, onder voorbehoud van andere informatie in het registratieformulier. Om veiligheidsredenen moet het wachtwoord zo ingewikkeld mogelijk zijn (de gebruikers worden hiervan zo nodig bij de registratie in kennis gesteld) en mag het niet elders worden gebruikt.

Forumberichten zijn zichtbaar voor het publiek, tenzij hun zichtbaarheid beperkt is tot specifieke leden of ledengroepen. De bijdragen van de auteurs worden opgeslagen met hun naam, indien geregistreerd of aangegeven, het tijdstip en de inhoud van de inzending. In het geval van registraties en het aanmaken van bijdragen, worden ook de IP-adressen van de gebruikers opgeslagen indien de bijdragen een ontoelaatbare inhoud hebben en de IP-adressen gebruikt zouden kunnen worden voor gerechtelijke vervolging. De verantwoordelijke behoudt zich het recht voor om registraties en inzendingen op basis van een passende beoordeling te verwijderen.

Single Sign-on Authenticatie

Single Sign-On" of "Single Sign-On Authentication of Logon" zijn procedures waarmee gebruikers zich kunnen aanmelden bij onze online diensten met behulp van een gebruikersaccount bij een aanbieder van Single Sign-On-diensten (bijv. een sociaal netwerk). Voorwaarde voor Single Sign-On-authenticatie is dat gebruikers geregistreerd zijn bij de desbetreffende Single Sign-On-provider en de vereiste toegangsgegevens invoeren in het daarvoor bestemde onlineformulier, of al ingelogd zijn bij de Single Sign-On-provider en de Single Sign-On-aanmelding bevestigen via de knop.

De authentificatie gebeurt rechtstreeks bij de respectievelijke single sign-on provider. In het kader van deze authenticatie ontvangen wij een gebruikers-ID met de informatie dat de gebruiker onder deze gebruikers-ID is aangemeld bij de betreffende single-sign-onprovider en een ID die niet voor andere doeleinden kan worden gebruikt (de zogenaamde "gebruikershandgreep"). Of wij nog meer gegevens ontvangen, hangt uitsluitend af van de gebruikte eenmalige aanmeldingsprocedure, de als onderdeel van de authenticatie geselecteerde gegevensvrijgave en ook welke gegevens de gebruiker in de privacy- of andere instellingen van zijn gebruikersaccount bij de eenmalige aanmeldingsprovider heeft vrijgegeven. Afhankelijk van de aanbieder van de eenmalige aanmelding en van de keuze van de gebruiker, kunnen er verschillende gegevens worden vrijgegeven, meestal het e-mailadres en de gebruikersnaam. Het wachtwoord dat door de single sign-on provider wordt ingevoerd als onderdeel van de single sign-on procedure is niet zichtbaar voor ons en wordt ook niet door ons opgeslagen.

De gebruikers worden erop gewezen dat hun bij ons opgeslagen gegevens automatisch kunnen worden vergeleken met hun gebruikersaccount bij de "single sign-on" provider, maar dat dit niet altijd mogelijk of reëel is. Als bijvoorbeeld de e-mailadressen van gebruikers veranderen, moeten gebruikers deze handmatig wijzigen in hun gebruikersaccount bij ons.

Wij kunnen single sign-on-authenticatie gebruiken, mits dit met de gebruikers is overeengekomen in het kader van de pre-vervulling of de uitvoering van de overeenkomst, in het kader van de verwerking van toestemming en anderszins gebruiken op basis van onze legitieme belangen en de belangen van de gebruikers bij een doeltreffend en veilig authenticatiesysteem.

Indien gebruikers besluiten de koppeling van hun gebruikersaccount met de Single Sign-On provider niet langer te willen gebruiken voor de Single Sign-On procedure, dienen zij deze koppeling binnen hun gebruikersaccount met de Single Sign-On provider te verwijderen. Als gebruikers hun gegevens bij ons willen verwijderen, moeten zij hun registratie bij ons annuleren.

Blogs and publication media

We use blogos or comparable means of online communication and publication (hereinafter "publication medium"). Readers' data will only be processed for the purposes of the publication medium to the extent necessary for its presentation and communication between authors and readers or for security reasons. For the rest, we refer to the information on the processing of visitors to our publication medium within the scope of this privacy policy.

Comment subscriptions: When users leave comments or other contributions, their IP addresses may be stored based on our legitimate interests. This is done for our safety, if someone leaves illegal contents (insults, forbidden political propaganda, etc.) in comments and contributions. In this case, we ourselves can be prosecuted for the comment or contribution and are therefore interested in the author's identity.

Furthermore, we reserve the right to process user data for the purpose of spam detection on the basis of our legitimate interests.

On the same legal basis, in the case of surveys, we reserve the right to store the IP addresses of users for the duration of the surveys and to use cookies in order to avoid multiple votes.

The personal information provided in the course of comments and contributions, any contact and website information as well as the content information will be stored permanently by us until the user objects.

Comment subscriptions: Follow-up comments can be subscribed to by users with their consent. Users will receive a confirmation email to verify that they are the owner of the email address entered. Users can unsubscribe from current comment subscriptions at any time. The confirmation email will contain information on the cancellation options. For the purposes of proving the users' consent, we store the time of registration along with the users' IP address and delete this information when users unsubscribe from the subscription.

You can cancel the receipt of our subscription at any time, i.e. revoke your consent. We may store the unsubscribed email addresses for up to three years based on our legitimate interests before deleting them to provide evidence of prior consent. The processing of these data is limited to the purpose of a possible defense against claims. An individual deletion request is possible at any time, provided that the former existence of a consent is confirmed at the same time.

Akismet Anti-Spam Checking: We use the "Akismet" service on the basis of our legitimate interests. With the help of Akismet, comments from real people are distinguished from spam comments. All comments are sent to a server in the USA, where they are analyzed and stored for four days for comparison purposes. If a comment has been classified as spam, the data will be stored beyond that time. This information includes the name entered, the e-mail address, the IP address, the comment content, the referrer, information about the browser used, the computer system and the time of the entry.

Users are welcome to use pseudonyms, or to refrain from entering their name or email address. You can completely prevent the transmission of data by not using our comment system. That is a pity, but unfortunately we do not see any alternatives that work just as effectively.

DISQUS comment function: We use the DISQUS comment service on the basis of our legitimate interests in efficient, secure and user-friendly comment management.

To use the DISQUS comment function, users can register via their own DISQUS user account or an existing social media account (e.g. OpenID, Facebook, Twitter or Google). DISQUS obtains the user registration data from the platforms. It is also possible to use the DISQUS comment function as a guest, without creating or using user accounts with DISQUS or any of the specified social media providers.

We merely embed DISQUS and its functions into our website, whereby we can influence the comments of the users. However, the users enter into a direct contractual relationship with DISQUS, within the framework of which DISQUS processes the user's comments and is a contact person for any deletion of the user's data. We refer to DISQUS' privacy policy and point out that users can assume that DISQUS stores not only the comment content but also their IP address and the time of the comment as well as cookies on the user's computer and can use them to display advertisements.

Gravatar Profile Pictures: We use the service Gravatar within our on-line offer and in particular in the Blog.

Gravatar is a service where users can register and store profile pictures and their e-mail addresses. If users leave contributions or comments with the respective e-mail address on other online presences (especially in blogs), their profile pictures can be displayed next to the contributions or comments. For this purpose, the e-mail address provided by the users is transmitted to Gravatar in encrypted form for the purpose of checking whether a profile is stored for it. This is the only purpose of transmitting the email address and it will not be used for other purposes, but deleted thereafter.

The use of Gravatar is based on our legitimate interests, as we use Gravatar to offer authors of contributions and comments the opportunity to personalize their contributions with a profile picture.

By displaying the images, Gravatar knows the IP address of the user, as this is necessary for communication between a browser and an online service.

If users do not want a user image linked to their e-mail address to appear in the comments at Gravatar, they should use an e-mail address which is not stored at Gravatar for commenting. We would also like to point out that it is also possible to use an anonymous e-mail address or no e-mail address at all if users do not wish their own e-mail address to be sent to Gravatar. Users can completely prevent the transmission of data by not using our comment system.

Communication via Messenger

We use messenger services for communication purposes and therefore ask you to observe the following information regarding the functionality of the messenger services, encryption, use of the metadata of the communication and your objection options.

You can also contact us by alternative means, e.g. telephone or e-mail. Please use the contact options provided to you or use the contact options provided within our online services.

In the case of encryption of content (i.e. the content of your message and attachments), we point out that the communication content (i.e. the content of the message and attachments) is encrypted end-to-end. This means that the content of the messages is not visible, not even by the messenger service providers themselves. Chatbots and chat functions

We provide online chats and chatbot functions as a means of communication (together referred to as "Chat Services"). A chat is an online conversation that is conducted with a certain degree of immediacy. A chatbot is software that answers users' questions or informs them about messages. If you use our chat functions, we may process your personal data.

If you use our Chat Services within an online platform, your identification number is also stored within the respective platform. We may also collect information about which users interact with our Chat Services and when. Furthermore, we store the content of your conversations via the Chat Services and log registration and consent processes in order to be able to prove these in accordance with legal requirements.

We would like to inform users that the respective platform provider can find out that and when users communicate with our Chat Services and can collect technical information about the user's device used and, depending on the settings of their device, also location information (so-called metadata) for the purpose of optimising the respective services and for security purposes. Likewise, the metadata of communication via Chat Services (i.e., information about who has communicated with whom) could be used by the respective platform providers for marketing purposes or to display advertising tailored to users in accordance with their regulations, to which we refer for further information.

If users agree to activate information with regular messages to a chatbot, they have the possibility to unsubscribe from the information for the future at any time. The chatbot points out to users how and with which terms they can unsubscribe the messages. By unsubscribing from the chatbot messages, Users' data is deleted from the directory of message recipients.

We use the aforementioned information to operate our Chat Services, e.g. to address users personally, to answer their inquiries, to transmit any requested content and also to improve our Chat Services (e.g. to "teach" chatbots answers to frequently asked questions or to identify unanswered inquiries).

Information on Legal basis: We use the Chat Services on the basis of a consent if we first obtain the permission of the users to process their data by the Chat Services (this applies in cases where users are asked for consent, e.g. so that a chatbot regularly sends them messages). If we use Chat Services to answer user queries about our services or our company, this is done for contractual and pre-contractual communication. We use Internet-accessible software services (so-called "cloud services", also referred to as "Software as a Service") provided on the servers of its providers for the following purposes: document storage and administration, calendar management, e-mail delivery, spreadsheets and presentations, exchange of documents, content and information with specific recipients or publication of websites, forms or other content and information, as well as chats and participation in audio and video conferences.

The IP addresses of the users are also stored. However, we use provided IP masking procedures (i.e. pseudonymisation by shortening the IP address) to ensure the protection of the user's by using a pseudonym. In general, within the framework of the online marketing process, no clear user data (such as e-mail addresses or names) is secured, but pseudonyms. This means that we, as well as the providers of online marketing procedures, do not know the actual identity of the users, but only the information stored in their profiles.

The information in the profiles is usually stored in the cookies or similar memorizing procedures. These cookies can later, generally also on other websites that use the same online marketing technology, be read and analyzed for purposes of content display, as well as supplemented with other data and stored on the server of the online marketing technology provider.

Exceptionally, clear data can be assigned to the profiles. This is the case, for example, if the users are members of a social network whose online marketing technology we use and the network links the profiles of the users in the aforementioned data. Please note that users may enter into additional agreements with the social network providers or other service providers, e.g. by consenting as part of a registration process.

As a matter of principle, we only gain access to summarised information about the performance of our advertisements. However, within the framework of so-called conversion measurement, we can check which of our online marketing processes have led to a so-called conversion, i.e. to the conclusion of a contract with us. Facebook Pixel: With the help of the Facebook pixel, Facebook is on the one hand able to determine the visitors of our online services as a target group for the presentation of ads (so-called "Facebook ads"). We participate in rating procedures to evaluate, optimise and advertise our performance. If users rate us via the participating rating platforms or methods or otherwise provide feedback, the General Terms and Conditions of Business or Use and the data protection information of the providers also apply. In order to ensure that the evaluators have actually made use of our services, we transmit, with the consent of the customer, the necessary data relating to the customer and the service or products used to the respective rating platform (this includes the name, e-mail address, order number or article number). Rating Widget: We include so-called " rating widgets " in our online services. This means that user information can usually be analysed for marketing purposes, regardless of the browser or device used (e.g. mobile phone or desktop computer). With most Cross-Device Tracking providers, the online identifier is not linked to plain data such as names, postal addresses or e-mail addresses.
  • Custom Audiences: Target group formation (or "custom audiences") is the term used when target groups are determined for advertising purposes, e.g. display of advertisements. For example, a user's interest in certain products or topics on the Internet may be used to infer that that user is interested in advertisements for similar products or the online store in which they viewed the products. Lookalike Audiences" (or similar target groups) is the term used to describe content that is viewed as suitable by users whose profiles or interests presumably correspond to the users for whom the profiles were created. Cookies are generally used for the purposes of creating custom audiences and lookalike audiences. Target groups can be created by processing visitors of an online service or can be uploaded to the provider of an online marketing technology by means of uploading (which is usually done pseudonymised).
  • Firewall: A firewall is a security system that protects a computer network or a single computer from unwanted network access.
  • IP Masking: IP masking is a method by which the last octet, i.e. the last two numbers of an IP address, are deleted so that the IP address alone can no longer be used to uniquely identify a person. IP masking is therefore a means of pseudonymising processing methods, particularly in online marketing.
  • Interest-based and behavioral marketing: Interest-related and/or behaviour-related marketing is the term used when potential user interest in advertisements and other content is predicted if possible. This is done on the basis of information on the previous behaviour of users (e.g. visiting and staying on certain websites, purchasing behaviour or interaction with other users), which is stored in a so-called profile. For these purposes cookies are usually used.
  • Personal Data: "personal data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  • Processing: The term "processing" covers a wide range and practically every handling of data, be it collection, evaluation, storage, transmission or erasure.
  • Profiling: "Profiling" means any automated processing of personal data consisting in the use of such personal data to analyse, evaluate or predict certain personal aspects relating to a natural person (depending on the type of profiling, this includes information regarding age, gender, location and movement data, interaction with websites and their contents, shopping behaviour, social interactions with other people) (e.g. interests in certain contents or products, click behaviour on a website or the location). Cookies and web beacons are often used for profiling purposes.
  • Remarketing: Remarketing" or "retargeting" is the term used, for example, to indicate for advertising purposes which products a user is interested in on a website in order to remind the user of these products on other websites, e.g. in advertisements.
  • Server monitoring and error detection: With the help of server monitoring and error detection, we ensure the availability and integrity of our online service and use the data processed in this process to technically optimise our online services. For this purpose, performance, utilization and comparable technical values, which provide information about the stability and any conspicuous features of our online offer, are processed. In the event of errors and irregularities, individual requests from users of our online services are recorded in order to identify and eliminate sources of problems.
  • Targeting: Tracking" is the term used when the behaviour of users can be traced across several websites. As a rule, behavior and interest information with regard to the websites used is stored in cookies or on the servers of the tracking technology providers (so-called profiling). This information can then be used, for example, to display advertisements to users presumably corresponding to their interests.
  • Web Analytics: Web Analytics serves the evaluation of visitor traffic of online services and can determine their behavior or interests in certain information, such as content of websites. With the help of web analytics, website owners, for example, can recognize at what time visitors visit their website and what content they are interested in. This allows them, for example, to optimize the content of the website to better meet the needs of their visitors. For purposes of web analytics, pseudonymous cookies and web beacons are frequently used in order to recognise returning visitors and thus obtain more precise analyses of the use of an online service.
